- LEGAL SERIES
- 1 CPD POINT
Session overview:
Property law issues frequently arise during the preparation and assessment of development applications. Property issues can also arise after the grant of development consent, when it is sought to be implemented.
In this session we will explore issues that planners commonly encounter, including owner’s consent, when it is required for off-site impacts and how it can be compelled; when it is reasonable to propose or accept conditions of consent requiring the registration of covenants on land; satisfying essential service clauses in planning instruments, including the proprietary rights necessary for ‘suitable vehicular access’ to be provided to a site; the reasonableness of conditions of consent that seek to require the dedication of land; and options available to seek easements over land from the Supreme Court or Land and Environment Court under section 88K of the Conveyancing Act 1919; amongst others.
About the Series:
The Legal Series will bring together speakers with recognised expertise in various aspects of the NSW Planning System and provide a platform to educate, inform and provide solutions through short seminars focusing on topics identified by our members.
These seminars will provide the necessary information and practical help for those currently working in the planning profession and looking to improve their understanding of legal issues that impact on Planners.
